Holding

The Court granted provisional anticipatory bail, subject to verification of the petitioner’s antecedents, as the allegations did not establish possession and the petitioner had a clean record.

Summary

The petitioner, Gopal Kumar, sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 75 litres of liquor in a plastic bag on his motorcycle. He argued that he had no prior criminal record, the liquor was not found in his immediate possession, and he was unaware of his friend's alleged misuse of the vehicle. The State opposed the bail, contending the seriousness of the offence. The Court, considering the petitioner's clean antecedent and lack of direct possession, granted provisional anticipatory bail subject to a bail bond of Rs.500 and two sureties, with verification of his antecedents by the trial court. The order stipulated that if any prior case is discovered, the bail would be revoked; otherwise, it would be confirmed. The application was allowed.

Issues considered

  • What is the applicability of anticipatory bail under Section 30(a) of the Bihar Prohibition and Excise Act when the accused does not have the contraband in his immediate possession?
  • Whether ownership of the vehicle used for alleged transport of liquor suffices to justify denial of anticipatory bail.

                   APP for the State.

                                2. Petitioner apprehends his arrest in a case registered

                   Prohibition and Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

recovery of 75 litres of liquor from a plastic bag kept on a

motorcycle. It is next submitted that petitioner was not arrested

from the spot, as such, nothing was recovered from his

conscious possession and he came to be implicated based on the

fact that he is owner of the seized vehicle. It is next submitted

that no prudent person would use his own vehicle for

submitted that petitioner was completely unaware that his friend

would misuse the vehicle in the manner as alleged.

                       4. Learned A.P.P. opposes the anticipatory bail

          application.

                       5. Considering the submissions made by the learned

counsel for the petitioner, the petitioner, above-named, in the

event of his arrest or surrender before the learned Court below

within a period of six weeks, is directed to be released on

provisional anticipatory bail on his furnishing bail-bond in the

                       7. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioner shall verify

the criminal antecedent of the petitioner and in the event, if it is

found that petitioner has antecedent of even one case, then it
