Patna High Court

Ravi Bind @ Ravi KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the simple nature of injuries and the petitioners’ clean antecedent, anticipatory bail could be granted subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

Petitioners Ravi Bind and Disco Kumar were accused of assaulting an informant with an iron rod and lathi, and also assaulting the informant's husband and daughter, leading to a FIR under multiple sections of the Bharatiya Nyaya Sanhita. They applied for anticipatory bail, claiming innocence, simple injuries, and a clean antecedent. The informant opposed the bail. The court examined the nature of the accusations, the severity of injuries, and the petitioners' clean record, and concluded that these factors did not warrant denial of bail. Consequently, the court granted anticipatory bail, directing the petitioners to surrender within eight weeks and to furnish a bail bond of Rs. 10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order was pronounced by Justice Prabhat Kumar Singh.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under the circumstances of the alleged offences
  • Whether the nature and severity of injuries justify denial of bail
