Amit KumarversusThe State of Bihar

DISPOSED

Holding

The court held that anticipatory bail may be granted where the petitioner has a clean antecedent and the seized liquor was not in his conscious possession, subject to verification of antecedents.

Summary

Amit Kumar, the owner of a vehicle from which 92.35 litres of liquor was seized, applied for anticipatory bail, claiming he had no knowledge of the driver’s misuse and possesses a clean criminal record. The State opposed the bail, alleging offences under Sections 30(a) and 47 of the Bihar Prohibition and Excise Act. The court examined the petitioner’s lack of conscious possession of the liquor and his clean antecedents. It granted provisional anticipatory bail conditioned on a Rs.500 bond, two sureties, and verification of the petitioner’s criminal history by the trial court. If any antecedent is discovered, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the vehicle owner under Sections 30(a) and 47 of the Bihar Prohibition and Excise Act.
  • Whether the lack of conscious possession and clean antecedent justify anticipatory bail.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

came to be implicated based on the fact that he is owner of the

seized vehicle. It is next submitted that no prudent person would

use his own vehicle for committing an occurrence and thus

completely unaware that his driver would misuse his vehicle in

          the manner as alleged.
