Sidhnath PaswanversusThe State of Bihar

Holding

The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s antecedent and compliance with Section 482(2) of the BNSS.

Summary

The petitioner, Sidhnath Paswan, sought anticipatory bail after learning that a case had been registered against him under Section 30(a) of the Bihar Excise Act for the alleged recovery of 25 litres of liquor from his residence. He contended that he has a clean criminal record, that the liquor was not in his conscious possession, and that the house is a joint family property, making it uncertain whether he knew of the liquor. He further argued that the 2018 amendment to the Excise Act had abolished the concepts of deemed possession and presumed offender. The State opposed the grant of anticipatory bail. The Court, after considering the submissions, ordered provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and directed the trial court to verify the petitioner’s antecedent, with confirmation of bail if no prior case is found.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where the alleged possession is not in conscious control.
  • Whether the 2018 amendment to the Bihar Excise Act eliminates the doctrine of deemed possession and presumed offender.
  • Whether joint family ownership of the premises affects liability for the alleged liquor possession.

such it cannot be alleged with certainty that it was petitioner

who had kept the liquor in the house or the liquor kept in the
