The Court granted provisional anticipatory bail subject to verification of the petitioner’s antecedent, with the bail to be confirmed only if he has no more than two prior cases.

Summary

The petitioner, Dhananjay Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning alleged recovery of 70 litres of liquor from a public water tank. He contended that the liquor was not in his conscious possession, the location did not belong to him, and the case was based solely on a confessional statement made by another accused, Vinod, while in police custody. The petitioner also highlighted his antecedent of two prior excise cases, arguing that the police had mechanically implicated him without proper investigation. The State opposed the grant of anticipatory bail. The High Court, after considering the submissions, ordered provisional anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and directed verification of the petitioner’s criminal antecedent. It further stipulated that if more than two prior cases are found, the bail would not be confirmed, whereas confirmation would follow if only two antecedents are verified.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Excise Act.
  • Whether a confessional statement made by a co-accused in police custody can form the basis for arrest.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.

based on confessional statement of Vinod in police custody

which does not have any evidentiary value. It is further
