The Court conditionally granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent.
Summary
Arun Ray, the owner of a pickup vehicle, feared arrest in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 495 litres of liquor. He argued that he had a clean antecedent, was not in possession of the liquor, and was unaware that a person named Suraj misused his vehicle, leading to the seizure. The State opposed his request for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish bail bonds and sureties, and that the trial court verify his antecedent within six weeks. If any prior case is discovered, the bail will not be confirmed; otherwise, it will be confirmed forthwith.
