Patna High Court

Prem Sagar KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, directing his release upon furnishing the prescribed bond and sureties.

Summary

Prem Sagar Kumar was arrested in connection with a theft alleged to have occurred in a mobile accessories shop, though his name does not appear in the FIR. The prosecution’s case rests solely on the confessional statement of a co‑accused, Manish Kumar, and no incriminating material has been recovered from the petitioner. The co‑accused had already been granted bail, and the investigation is complete with a charge‑sheet filed, while the alleged stolen mobile has not been identified. The petitioner, who has been in custody since 10‑Oct‑2025 and claims a clean antecedent, sought bail under Sections 334(1) and 303(2) of the Bhartiya Nyaya Sanhita. The Court, noting the lack of material evidence, the completed investigation, and the conditions of Sections 437(3) of the CrPC and 480(3) of the Bhartiya Nagrik Suraksha Sanhita, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner in a case under Sections 334(1) and 303(2) of the Bhartiya Nyaya Sanhita when the only evidence is a co‑accused’s confessional statement and no material has been recovered.
  • Whether the completion of investigation and filing of charge‑sheet preclude the risk of tampering with evidence, justifying bail.
