MANISH KUMARversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the anticipatory bail application, directing release on bond and sureties subject to conditions under Section 482(2) of the BNSS.

Summary

Manish Kumar and Gaurav Kumar, brothers, applied for anticipatory bail fearing arrest in a case registered under multiple sections of the Bihar Negotiable Statutes (BNSS) 2023. They claim they were falsely implicated by a neighbour with whom they have a land dispute, and that the alleged assault with a pistol was not reported under the Arms Act and the injury was minor. The petitioners also highlighted their prior criminal antecedents and alleged that the informant had filed a counter‑case against them. The State opposed the bail, arguing the seriousness of the offences. The Court, after considering the submissions, granted anticipatory bail subject to a bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the BNSS, directing release if arrested within six weeks.

Issues considered

  • Whether anticipatory bail can be granted in the present case despite the serious nature of the offences alleged.
  • Whether the allegations of assault with a firearm necessitate registration under the Arms Act for bail considerations.
  • Whether the petitioners' prior criminal antecedents preclude the grant of anticipatory bail.
  • Whether the land dispute and alleged false implication affect the bail application.
