BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners, subject to surrender within six weeks and compliance with bail bond conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioners, four residents of Bela village in Gurua, filed an anticipatory bail application fearing arrest in a case (PS Case No.303 of 2025) that alleged offences under Sections 109, 115(2), 118(1), 117(2), 132, 190, 191(2), 191(3), 196 and 299 of the B.N.S. The petitioners contended they have clean antecedents and were falsely implicated by an informant who claimed the police, acting on S.D.O. orders, had entered the village to restore law and order, during which a large group of accused allegedly assaulted the police. Their counsel argued that the FIR allegations of assault were vague, general and omnibus, and that the petitioners were not involved in any criminal activity. The State opposed the anticipatory bail, asserting that the petitioners were part of the alleged mob. The Court, after considering the submissions, held that the petitioners could be released on anticipatory bail provided they surrender within six weeks and furnish bail bonds of Rs.10,000 with two sureties each, subject to the conditions of Section 482(2) of the B.N.S.S. The application was therefore allowed.

Issues considered

  • Whether the petitioners are entitled to anticipatory bail under the provisions of the B.N.S.S. in view of the allegations in the FIR
  • Whether the FIR allegations against the petitioners are specific enough to justify denial of bail
  • Whether the conditions imposed under Section 482(2) are appropriate for granting anticipatory bail
