Patna High Court

Muzaffar Hussain @ Md. Muzaffar HussainversusTHE STATE OF BIHAR

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners, subject to surrender within six weeks and furnishing of bail bonds with sureties.

Summary

The petitioners, four residents of Kachna village, sought anticipatory bail fearing arrest in a case registered under multiple sections of the Bihar National Security Act, 2023, alleging they formed an unlawful assembly, created a ruckus, and assaulted police while demanding the release of a detainee. The petitioners contended that they were falsely implicated by an informant and that the FIR allegations were vague and omnibus. The State opposed the bail, arguing the seriousness of the offences. The Court examined the petitioners' antecedents, the nature of the allegations, and the statutory power under Section 482(2) of the Bihar National Security Act to prevent abuse of process. It held that anticipatory bail could be granted provided the petitioners surrender within six weeks and furnish bail bonds with sureties, subject to conditions. Consequently, the petitioners were released on anticipatory bail on the stipulated terms.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the Bihar National Security Act, 2023.
  • Whether the FIR allegations are sufficiently specific to justify denial of bail.
  • Whether the petitioners have been falsely implicated by the informant.
