BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to a bond, sureties and conditions under section 482(2) of the BNSS.

Summary

The petitioners, five residents of Kubauli village, sought bail after being implicated in a FIR alleging that they, along with co‑accused, trespassed into an informant's house and stole Rs.1,50,000 and jewellery. They claimed innocence, asserting that the allegations were false and stemmed from an old enmity, and highlighted their clean antecedents. The State opposed the bail application, emphasizing the seriousness of the offences listed under the Bharatiya Nagarik Suraksha Sanhita (BNSS). The Court examined the bail provisions under section 482(2) of the BNSS, the nature of the accusations, and the petitioners' background. Considering the lack of concrete evidence and the petitioners' clean record, the Court ordered bail on a bond of Rs.10,000 each with two sureties, subject to surrender within eight weeks and compliance with conditions. The bail order was conditioned on the satisfaction of the learned Sub‑Divisional Judicial Magistrate, Samastipur.

Issues considered

  • Whether bail should be granted to the petitioners under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita despite the serious nature of the offences alleged in the FIR.
