Patna High Court

Sudhakar Singh @ Sonu Singh @ Kumar SudhakarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the stipulated conditions.

Summary

Sudhakar Singh applied for anticipatory bail after being implicated in a case (PS No. 318 of 2025) for alleged assault with an iron rod, invoking multiple offences under the Bharatiya Nyaya Sanhita. The petitioner asserted his innocence, claimed the injury was minor, and highlighted his clean antecedent. The State opposed the bail, arguing the seriousness of the charges. The court examined the nature of the allegations, the extent of injury, and the petitioner’s record, and concluded that anticipatory bail was appropriate. Accordingly, the court granted anticipatory bail, directing the petitioner to surrender within eight weeks, furnish a bail bond of Rs.10,000 with two sureties, and comply with conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted in view of the alleged offences under the Bharatiya Nyaya Sanhita
  • Whether the nature of the alleged injury and the petitioner's clean antecedent justify bail
  • Whether conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, are satisfied
