Holding

The court grants bail to the petitioner.

Summary

Gopal Yadav applied for bail in a case (Kotwali P.S. Case No.467 of 2013) involving multiple offences under the Indian Penal Code and the Bihar Medical Service Institution and Person Protection Act, alleged to have assaulted doctors, nurses and hospital staff. The prosecution’s FIR named five accused and 10‑12 unknown persons, but the petitioner’s name was not originally in the FIR and he claims he was falsely implicated. He contended that his wife died in the same hospital due to alleged medical negligence and that he has been in custody since 20‑07‑2025 with two prior criminal antecedents. The State opposed bail, citing the seriousness of the charges. After considering the facts, the court found the petitioner’s claim of false implication credible and, taking into account the period of custody, decided to grant bail. The bail was set at Rs.15,000 with two sureties of the same amount each.
