The Court denied pre‑arrest bail to the petitioner.
Summary
The petitioner, Santu Ravidas, sought pre‑arrest bail after being implicated in a case under Section 81 of the Bharatiya Nyaya Sanhita. The prosecution alleged that he had a relationship with an informant, became pregnant, and was pressured to marry, with a Panchayat convened to formalise the marriage which was later refused. The petitioner contended he was innocent, that no physical relationship existed, and that the charges were fabricated to coerce marriage. The State opposed bail, relying on the victim’s statement recorded under Section 183 of the BNSS. The Court, considering the seriousness of the accusation and the victim’s statement, rejected the petition for pre‑arrest bail.
Issues considered
- Whether the petitioner is entitled to pre‑arrest bail under Section 81 of the Bharatiya Nyaya Sanhita in view of the victim’s statement under Section 183 BNSS.
