Holding

The Court rejected the petitioner's anticipatory bail application.

Summary

The petitioner, Abhishek Kumar, sought anticipatory bail after being implicated in a case (Goraul PS Case No. 436 of 2025) involving alleged kidnapping, robbery, sexual assault, blackmail, and extortion, with charges under several sections of the Bihar Narcotic Substances Act, 2023 and Sections 66A and 67A of the Information Technology Act. He asserted that he has a clean record, is a government servant (driver at a Community Health Center), and was falsely implicated. The State contended that the petitioner is not a government servant and that the investigation is ongoing, noting that a video of the alleged victim had gone viral showing the victim fully unveiled. The SHO and Investigating Officer, who appeared in court, corroborated the State’s position. After hearing both sides, the Court declined to grant anticipatory bail, finding the petitioner’s contentions insufficient to merit the privilege, and consequently rejected the application.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in view of the allegations and the status of the investigation.
