BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners subject to the conditions prescribed under Section 438(2) CrPC and Section 482(2) BNS Act.

Summary

The petitioners, Uday Prasad and Tunni Kumar, sought anticipatory bail fearing arrest in a case registered under several sections of the Bihar Non‑Serious (BNS) Act and the Arms Act. They asserted they have clean antecedents and alleged that the informant falsely implicated them, claiming no specific allegation of assault was made against them. The State opposed the bail, arguing the seriousness of the offences. The court examined the submissions and, applying Section 438(2) of the Criminal Procedure Code and Section 482(2) of the BNS Act, ordered that the petitioners be released on anticipatory bail if arrested or surrendered within six weeks, upon furnishing a bail bond of Rs.10,000 with two sureties each. The bail was conditioned on compliance with the stipulated terms.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 438 CrPC and Section 482(2) BNS Act in view of the allegations.
  • Whether the petitioners can be considered falsely implicated and thus eligible for bail.

                   A.P.P. for the State.

                                2. The petitioners apprehend their arrest in a case

                                3. Learned counsel for the petitioners submits that

petitioners are persons with clean antecedent and the informant

alleges that petitioners came and started abusing his tenant and on

information the informant came to the place of occurrence when
