Patna High Court

Arjun Yadav @ Arjum Kumar Yadav @ Arjun KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to specified conditions.

Summary

Arjun Yadav was arrested in connection with offences under the Bharatiya Nyaya Sanhita, 2023 and the Arms Act, and has been in custody since 24‑10‑2024. An earlier application for regular bail was rejected by the Patna High Court on the ground of the seriousness of the alleged criminal conspiracy. The petitioner filed a second bail application, contending that continued pre‑trial detention violates his fundamental right to liberty under Article 21. The State opposed the bail, emphasizing the nature of the charges. The Court, noting the prolonged custody and the lack of any compelling reason to keep the petitioner detained, held that continued detention would be punitive and contrary to Article 21, and therefore granted bail subject to monetary surety and appearance conditions.

Issues considered

  • Whether the petitioner is entitled to bail despite the seriousness of the offences under the Bharatiya Nyaya Sanhita and the Arms Act.
  • Whether continued pre‑trial detention infringes the petitioner’s right to liberty under Article 21 of the Constitution.
