Patna High Court

Ajay YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner, subject to prescribed conditions.

Summary

The petitioner, Ajay Yadav, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly possessing 126 litres of liquor recovered from a motorcycle. He claimed false implication, noting that no liquor was found in his conscious possession and he had no link to the vehicle, while the State opposed bail. The court noted his 17 prior criminal antecedents and the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, but also considered the period of custody already served. Weighing these factors, the court decided to grant bail, subject to a bond of Rs. 15,000 with two sureties and several conditions regarding appearance, non‑tampering, and territorial restrictions. The order directed release after framing of charge, if not already done.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act despite his criminal antecedents
  • Whether the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, warrants denial of bail
  • Whether the petitioner’s alleged non‑involvement with the recovered liquor and the vehicle justifies bail
