The court granted anticipatory bail to the petitioners, subject to conditions, under Section 482(2) of the B.N.S.
Summary
The petitioners, Vinod Kumar Singh and Man Singh, applied for anticipatory bail anticipating arrest in a case alleging offences under several sections of the B.N.S., including assault, robbery and other violent crimes. They claimed to have clean antecedents and argued that the informant had falsely implicated them in a land‑dispute related incident. The prosecution opposed the bail, contending the seriousness of the alleged offences. The court examined the allegations, the petitioners' claim of false implication, and the need to ensure they do not tamper with evidence or flee. Relying on Section 482(2) of the B.N.S., the court directed that the petitioners be released on anticipatory bail upon furnishing bail bonds and sureties, subject to conditions. The application was therefore allowed.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the B.N.S. despite the serious nature of the alleged offences
- Whether the petitioners are likely to abscond, tamper with evidence, or commit further offences if released
- Whether the allegations against the petitioners are false and stem from a land‑dispute
