Patna High Court

Muliya Devi @ Phuliya DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to the stipulated bond and conditions.

Summary

The petitioners, members of the family of co-accused Nandan Mukhiya, sought bail after being apprehended in a case registered under multiple sections of the Bhartiya Nyaya Sanhita, including serious offences such as rape. They contended that the allegations against them were limited to simple assault and that the FIR was lodged four days after the incident without a satisfactory explanation, emphasizing their clean antecedents. The State opposed the bail, arguing the seriousness of the charges. The Court examined the delay in filing the FIR, the nature of the allegations against the petitioners, and the statutory provisions governing bail. Considering the circumstances, the Court ordered that the petitioners be released on bail upon surrender within eight weeks, subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether bail should be granted to the petitioners despite the serious nature of the charges under the Bhartiya Nyaya Sanhita.
  • Whether the four‑day delay in lodging the FIR warrants denial of bail.
  • Whether the conditions prescribed under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, are satisfied.
