Shishupal Paswan @ Deepak Paswan @ Deepak KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to bond and surety conditions.

Summary

Shishupal Paswan was arrested in connection with a case alleging assault with firearms and sharp weapons, charged under multiple sections of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The petitioner claimed innocence, stating he was merely an order‑giver and that no incriminating material was found on him. The State opposed bail, citing the seriousness of the offences. The Court considered the facts, the period of custody since 13‑08‑2025, and the petitioner’s two prior bail cases, and decided to grant bail. Bail was conditioned on a bond of Rs.15,000 with two sureties, one of whom must be a close family member, and on the petitioner’s appearance at every trial date, with cancellation possible after two consecutive defaults.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the period of custody and the petitioner’s antecedents justify the grant of bail
