Patna High Court

Md. Anwarul @ AnwarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioners, subject to bond and conditions, finding that further detention would be punitive and unconstitutional.

Summary

The petitioners, Md. Anwarul and Md. Pinku, were arrested in connection with offences under Sections 103(1), 238 and 61(2) of the Bharatiya Nyaya Sanhita, 2023. Their earlier applications for regular bail were rejected, with the court allowing a renewal after six months. They filed a second bail petition, arguing that only three of eight witnesses had been examined and that they had been in custody since 7 October 2024, making trial completion unlikely. The State opposed the bail. The court held that continued pre‑trial detention would amount to punitive incarceration and violate Article 21 of the Constitution, and therefore granted bail on a bond of Rs. 15,000 with two sureties and conditions of appearance.

Issues considered

  • Whether the continued pre‑trial detention of the accused violates the right to liberty under Article 21 of the Constitution of India.
  • Whether bail should be granted in a case involving offences under Sections 103(1), 238 and 61(2) of the Bharatiya Nyaya Sanhita, 2023 given the status of the trial.

                      4. Learned counsel for the petitioners submits that the

present one is the second attempt for grant of regular bail to the
