Bablu sahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner with conditions, finding that the evidence against him was insufficient to justify continued detention.

Summary

The petitioner, Ful Mohammad, was charged under Sections 334(1), 303(2), 324(5) and 61(2) of the Bhartiya Nyaya Sanhita, 2023 for allegedly stealing Rs 18,04,300 from an ICICI Bank ATM and setting the ATM on fire. The FIR named unknown miscreants, but the petitioner was implicated solely on the basis of a confessional statement made by co‑accused Rajesh Kumar, with no material recovered from him. The petitioner contended that he was falsely implicated and pointed to the earlier grant of bail to another co‑accused, Mohammad Sattar, as a precedent. The State opposed bail, citing the seriousness of the offences. After considering the lack of direct evidence, the petitioner’s custody since March 2025, and the precedent, the Court granted bail subject to a Rs 10,000 bond, two sureties, and several conditions regarding cooperation, attendance, and non‑tampering with evidence.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences and the reliance on a co‑accused’s confessional statement.
  • Whether the absence of recovered material and the existence of a prior bail order for a co‑accused justify granting bail.
