Patna High Court

Ful MohammadversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner subject to strict conditions.

Summary

The petitioner, Ful Mohammad, was charged under Sections 334(1), 303(2), 324(5) and 61(2) of the Bhartiya Nyaya Sanhita, 2023 for the theft of Rs. 18,04,300 and the arson of an ICICI Bank ATM. He claimed innocence, arguing that the FIR was lodged against unknown persons and that his implication rested solely on the confessional statement of co‑accused Rajesh Kumar, with no material recovered from him. The petitioner highlighted that a similarly situated co‑accused, Mohammad Sattar, had been granted bail by a coordinate bench. The State opposed bail, citing the seriousness of the offences and the petitioner’s prior custody. After considering the submissions, the court granted bail on a cash bond of Rs. 10,000 with two sureties, imposing conditions such as regular court attendance, a blood‑relative bailor, and obligations to report any further similar accusations. The order also allowed for cancellation of bail if the petitioner tampered with evidence or failed to appear.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences under the Bhartiya Nyaya Sanhita, 2023.
  • Whether the confessional statement of a co‑accused alone suffices to justify continued detention.
  • Whether the precedent of bail granted to a co‑accused (Mohammad Sattar) influences the bail decision in the present case.
