Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

The petitioner, Anarjit Bin, was charged under Sections 103(1), 238 and 3(5) of the Bhartiya Nyaya Sanhita for the alleged murder of Raushan Bin, the husband of an informant, in a purported conspiracy. The prosecution alleged that Raushan Bin drowned while collecting wood, but his body was never recovered and the post‑mortem showed no external injuries. The petitioner contended that he was falsely implicated, that the FIR was lodged nine days after the incident without explanation, and that there was no material linking him to the crime beyond suspicion. He had been in custody since 30‑09‑2025 and had no prior criminal record. After hearing both sides, the court ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties, satisfying the Judicial Magistrate.

3 11-02-2026 Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner seeks bail in connection with Piprasi

P.S. Case No. 74 of 2025 dated 10.09.2025 instituted for the

offence punishable under Sections 103(1), 238, 3(5) of the

                   Bhartiya Nyaya Sanhita, 2023.

                                3. As per the prosecution case, on the alleged date of

occurrence, the husband of the informant, namely, Raushan Bin

went to collect wood from river with accused persons as named

in the F.I.R. All the accused persons returned except informant’s

husband. When the informant asked accused persons about her

husband, they stated that he drowned in the river. Thereafter,

dead body of Raushan Bin was searched by family members of

the informant as well as N.D.R.F., but it could not be traced out.

                                            2/3

It is further alleged that informant’s husband was killed under a

planned conspiracy by the accused persons including the

          petitioner.

                        4. Learned counsel for the petitioner submits that the

petitioner is innocent and he has been falsely implicated in this

case. Learned counsel for the petitioner further submits that the

occurrence took place on 01.09.2025 while the F.I.R. has been

lodged on 10.09.2025 after nine days of the occurrence without

any plausible explanation. It is further submitted that after

investigation, the police submitted charge-sheet under Section

105, 3(5) of Bhartiya Nyaya Sanhita. After recovery of the dead

body, the post-mortem was done, but the post-mortem report

does not disclose any external injury. There is no material

against the petitioner which would connect him to this case.

Only on the basis of suspicion, the petitioner was taken into

custody. Lastly, it has been submitted that the petitioner is in

custody since 30.09.2025 having no criminal antecedents.

Charge-sheet has been submitted in the case.

                        5. Learned A.P.P. has opposed the prayer for bail of

          the petitioner.

                        6. Having considered the facts and circumstances of

the case and submissions of learned counsel for the parties, let
