Sakunti DeviversusThe State of Bihar

BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioners subject to bond and surety conditions.

Summary

The petitioners, Sakunti Devi and Garib Yadav, sought anticipatory bail in a dowry‑death case (Rupau P.S. Case No. 101 of 2025) registered under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that the deceased was killed by her in‑laws for non‑payment of dowry, but the petitioners claimed they were innocent, had no specific allegations against them, and were merely the mother‑ and father‑in‑law of the deceased. Their counsel highlighted the lack of criminal antecedents and pointed to a similar bail order granted to a co‑accused in another case. The State opposed the bail. Considering the facts, the court granted anticipatory bail subject to a bond of Rs. 15,000 and two sureties, and imposed conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the allegations against the petitioners are sufficiently specific to deny bail.
  • Whether the conditions prescribed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, are applicable.
