Ranjeet KumarversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

The petitioner, Ranjeet Kumar, sought anticipatory bail fearing arrest in Cyber P.S. Case No. 91 of 2025, which alleged offences under several sections of the Bharatiya Nyaya Sanhita, 2023. The prosecution’s case is based on a raid that recovered electronic devices and on statements of a co‑accused, Shivam Kumar, who confessed involvement in a fake loan scheme. The petitioner contended that he was falsely implicated, that the allegations were vague and omnibus, and that no specific overt act was attributed to him, also highlighting his clean criminal record. The State opposed the bail, arguing the seriousness of the charges. The Court, after considering the submissions, granted anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes a bail bond of Rs.15,000 with two sureties, and complies with conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the allegations and evidence.
  • Whether the allegations based on co‑accused testimony constitute sufficient ground to deny bail.
  • Applicability of Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023 in granting anticipatory bail.
