BAIL GRANTED

Holding

The court granted bail to the petitioner subject to prescribed conditions.

Summary

Yogesh Suresh Chauthe was arrested in connection with a cyber‑fraud case (Cyber P.S. Case No. 63 of 2025) alleging extortion, blackmail and threats of suicide, punishable under Sections 316(2), 318(4), 308(2) of the B.N.S., 2023 and Sections 66(c), 66(d) of the Information Technology Act, 2000. The prosecution alleged that the accused befriended a woman on Facebook, demanded large sums of money and gold jewellery, and threatened self‑harm to coerce payment. The petitioner pleaded innocence, claimed the FIR was false and malicious, and sought regular bail after being in custody since 28‑08‑2025 with a chargesheet filed on 18‑10‑2025. The court examined the seriousness of the offences, the duration of custody, and the lack of prior criminal record, and decided to grant bail with a bond of Rs.10,000 and two sureties, subject to conditions of personal appearance and a relative as bailor. The bail petition was allowed and the petitioner was ordered to be released on bail.

Issues considered

  • Whether bail should be granted to the accused in a case involving alleged cyber‑extortion, blackmail and threats under the B.N.S., 2023 and the IT Act, 2000.
  • Whether the nature of the offences and the period of custody justify denial of bail.
