The Court granted bail to the petitioner.
Summary
Vikash Kumar applied for bail in a case registered under Section 394 of the Indian Penal Code and Section 27 of the Arms Act, alleging robbery and shooting. The prosecution alleged that three miscreants, including the petitioner, intercepted and robbed an informant, causing injuries. The petitioner contended he was not named in the FIR and was implicated solely on the confessional statement of co-accused Natwar Kumar, which he argued lacks evidentiary value, and that no material was recovered from him. He also highlighted that he had not been subjected to a Test Identification Parade and had been in judicial custody since 18‑11‑2025 despite having three prior criminal antecedents. The State opposed bail, but the Court, after considering the lack of direct evidence and the circumstances, ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties.
Issues considered
- Whether the confessional statement of a co-accused is sufficient grounds to deny bail.
- Whether the petitioner’s lack of direct incriminating evidence and non‑participation in a TIP justify granting bail.
- Whether the petitioner’s prior criminal antecedents warrant denial of bail for offences under IPC Sec. 394 and Arms Act Sec. 27.
