Shanti DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner on the condition of a bail bond and two sureties.

Summary

Shanti Devi, the wife of a deceased man, applied for regular bail in a murder case registered under sections 103(1), 123 and 3(5) of the Bhartiya Nyaya Sanhita, 2023. The prosecution alleged that she and her neighbour Ganesha Murmu had an affair and jointly assaulted the deceased, causing his death. The petitioner contended that the allegations were false, there was no affair, and the post‑mortem report showed no external injuries on the body. The State opposed bail, but the court noted the lack of physical injury, the petitioner’s six‑month pre‑trial detention, and the filing of the charge‑sheet. Consequently, the court ordered that bail be granted on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the accused in a murder case under sections 103(1), 123 and 3(5) of the Bhartiya Nyaya Sanhita, considering the post‑mortem findings and the length of pre‑trial detention.
