Patna High Court

Rajendra RamversusThe State Of Bihar

Decided
Disposal
DISPOSED

Holding

The petition is disposed of because the trial court had already disposed of the case, rendering the relief sought under Section 482 unnecessary.

Summary

The petitioner, Rajendra Ram, filed a petition under Section 482 of the Criminal Procedure Code seeking to quash an order dated 10 October 2017 in which the 9th Additional Sessions Judge, Muzaffarpur, rejected his request for discharge in S.Tr. No. 272 of 2017. The petition argued that the matter had already been disposed of by the trial court on 29 March 2019, as reflected in a report dated 22 August 2025. The State of Bihar, represented by an Additional Public Prosecutor, raised no objection to the petitioner's prayer. The High Court, after hearing counsel and reviewing the trial court’s report, noted that the case had indeed been disposed of and therefore found no merit in continuing the petition. Consequently, the Court disposed of the petition, effectively granting the relief sought.

Issues considered

  • Whether a petition under Section 482 Cr.P.C. for quashing an order can be entertained when the trial court has already disposed of the case.
  • Whether the order rejecting the petitioner's discharge application can be set aside in view of the subsequent disposal of the trial.
