Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner, directing release upon furnishing the prescribed bail bond and sureties.

Summary

The petitioner, Nabab Giri, applied for regular bail in a criminal case registered under Sections 126(2), 127(2), 115(2), 118(1) and 109 of the BNS, 2023, alleging assault during a land dispute. The FIR alleges that the informant's father was attacked with a rod, sword and kulad, and the petitioner is named in a general, omnibus allegation. The petitioner’s counsel highlighted his clean antecedents and that he has been in custody since 08‑11‑2025, arguing that the specific assault was committed by another accused, Rahul. The State opposed bail, contending the seriousness of the offences. The Court, after considering the submissions, found no substantive reason to deny bail and ordered the petitioner’s release on furnishing a bail bond of Rs.10,000 with two sureties, pending trial in Bibhutipur Police Station Case No. 204 of 2025.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences alleged under the BNS, 2023.
  • Whether the allegations against the petitioner are specific enough to justify denial of bail.
