BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner.

Summary

The petitioner, Durgesh Yadav, applied for anticipatory bail in a case arising from a land dispute where he was alleged to have assaulted his neighbour with iron knuckles, causing a head injury. The FIR listed offences under Sections 126(2), 115(2), 109, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner argued that the injury was simple and caused by a blunt object, not the alleged iron knuckles, and that both parties were neighbours with a passage dispute. The prosecution contended that the assault was intentional and intended to cause grievous injury. Considering the nature of the injury and the neighbourly dispute, the Court was inclined to grant anticipatory bail, subject to a bail bond and sureties, and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The application for anticipatory bail was therefore allowed.

Issues considered

  • Whether anticipatory bail should be granted in a case of alleged assault causing simple injury arising from a land dispute
  • Whether the alleged use of iron knuckles constitutes an offence under the cited sections of the Bharatiya Nyaya Sanhita
  • Whether the conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita are satisfied for granting bail
