Patna High Court

Sohit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a monetary bond and specific conditions.

Summary

The petitioner, Sohit Kumar, was implicated in a cyber fraud case (Sheikhpura Cyber PS Case No. 29 of 2025) based on an FIR dated 25.08.2025, alleging offences under several sections of the Bhartiya Nyay Sanhita, 2023 and the IT Act, 2008. He contended that he has a clean antecedent and that his name was mentioned only through the disclosure of a co-accused, Rohit Kumar, with no other material linking him to the crime. The Additional Public Prosecutor opposed his bail application. The Court considered the lack of independent evidence against the petitioner and his clean record, and consequently granted bail subject to a bond of Rs. 10,000 with two sureties and several conditions under Section 438(2) of the CrPC and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita. The bail order also imposed obligations to cooperate with the trial, avoid tampering with evidence or witnesses, and disclose any concealed criminal antecedent. The bail bond is to be verified by the lower court, but its acceptance shall not be delayed for verification purposes.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious offences alleged under the Bhartiya Nyay Sanhita and the IT Act.
  • Whether the petitioner’s alleged involvement, based solely on co-accused disclosure, warrants pre‑trial detention.
