NARENDRA SINGH @ BAUA SINGH @ BARUA SINGH @ NARENDRA SINHAversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Narendra Singh was arrested on July 1, 2025 in connection with a Bodhgaya police case alleging that he assaulted the informant's mother with an iron rod, causing injury. The FIR charges him under Sections 115(2), 126(2), 352, 109, 74, 351(2) and 351(3) of the B.N.S., 2023. The petitioner claimed a clean antecedent and argued that the case arose from a petty dispute and that the informant had filed a compromise petition and did not wish to pursue the matter. The court considered the compromise, the lack of prior criminal record, and the nature of the offences, and decided to grant bail on a bond of Rs.10,000 with two sureties and several conditions regarding trial cooperation, non‑tampering with evidence, and verification of antecedents. The bail order was directed to the Chief Judicial Magistrate, Gaya, and stipulated that failure to comply with conditions could lead to cancellation.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences charged under the B.N.S., 2023.
  • Whether the informant's desire for a compromise influences the grant of bail.
  • Whether the conditions imposed by the court are appropriate for ensuring the petitioner's cooperation with the trial.
