The Court granted bail to the petitioner, subject to cash bond and conditions.
Summary
Mithlesh Rai applied for bail in a dowry death case (Sections 304B, 201 and 34 IPC) where he is alleged to have participated in the torture and killing of an informant's daughter over dowry demands. The petitioner claimed innocence, stating he was falsely implicated, has no criminal antecedent, and was merely the brother‑in‑law of the deceased, living separately from the family. He highlighted that the husband of the deceased had already been acquitted and that a co‑accused in the same case had been granted bail, invoking the principle of parity. The State opposed bail, arguing the petitioner could have participated in the offence. Considering the charge sheet was already filed, the petitioner’s clean record, lack of specific allegations, and the risk of evidence tampering being low, the Court granted bail with a cash bond of Rs.10,000 and two sureties, subject to conditions of personal appearance and non‑tampering.
Issues considered
- Whether bail should be granted to an accused in a dowry death case where the charge sheet is filed.
- Whether the principle of parity with a co‑accused previously granted bail warrants bail for the petitioner.
- Whether the petitioner poses a risk of tampering with evidence or fleeing.
