The Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent and compliance with the conditions imposed under Section 482(2) of the Criminal Procedure Code.
Summary
The petitioner, Kamal Sahni, was implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly recovering 40 litres of liquor and 6,000 litres of fermented Mahua solution from a public place. He asserted that he has a clean criminal record, was not caught in possession, and that the police falsely implicated him to shield the real culprits. The State opposed his application for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.5,000 with two sureties and that the trial court verify his antecedent within six weeks. The order is subject to Section 482(2) of the Criminal Procedure Code, and if any prior case is discovered, the bail will not be confirmed; otherwise, it will be confirmed forthwith.
Issues considered
- What is the applicability of anticipatory bail under Section 482(2) of the Criminal Procedure Code in a case under Section 30(a) of the Bihar Excise Act?
- Whether the petitioner’s clean antecedent and lack of possession justify the grant of anticipatory bail?
