BAIL GRANTED

Holding

The court allowed the application and granted anticipatory bail to the petitioner.

Summary

The Patna High Court considered an application for anticipatory bail filed by Jaleshwar Prasad Singh, a 76‑year‑old accused in a case registered under multiple sections of the Bihar Negotiable Security Act, 2023 and the Arms Act. The petitioner claimed he was falsely implicated and that the FIR contained only a vague, omnibus allegation against him. The informant opposed the bail, arguing that the charges were serious. The court noted the lack of specific allegations and the petitioner’s advanced age, and held that these factors warranted the grant of anticipatory bail. Accordingly, the court ordered that the petitioner be released on bail upon furnishing a bond of Rs 10,000 with two sureties, subject to conditions under Section 482 of the BNSS and Section 438(2) of the CrPC.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite a general omnibus allegation in the FIR
  • Whether the petitioner’s advanced age and alleged false implication justify bail
