BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to bond and surety conditions under Section 482 of the BNSS and Section 438(2) of the CrPC.

Summary

The petitioner, Ranjan Kumar, sought anticipatory bail fearing arrest in a kidnapping case (Doriganj P.S. Case No. 215 of 2025) filed under Sections 87 and 3(5) of the Bharatiya Nyaya Sanhita. The prosecution alleged that he kidnapped the victim, while the petitioner claimed innocence and false implication. The victim’s statement indicated she had married the petitioner and was a major, which the petitioner’s counsel highlighted. The State opposed the bail, arguing the seriousness of the charges. The Court, after considering the facts and submissions, granted anticipatory bail on the condition of a Rs.10,000 bond with two sureties, subject to Section 482 of the BNSS and Section 438(2) of the CrPC.

Issues considered

  • Whether anticipatory bail should be granted under Section 438 of the CrPC in a kidnapping case under the BNSS.
  • Whether the allegations under Sections 87 and 3(5) of the BNSS justify denial of bail.
  • Whether the victim's claim of marriage to the petitioner impacts the bail decision.
