The Court granted provisional anticipatory bail subject to conditions and verification of the petitioners' criminal antecedents.
Summary
The petitioners, Jaijai Mandal and others, feared arrest in a case registered under Sections 336(3), 274, 275 and 3(5) of the Bihar Narcotic Substances Act and Sections 30(a) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022, relating to the alleged recovery of 1,330.2 litres of liquor from a Bolero pick‑up. They contended that they were not arrested on the spot, no liquor was found in their possession, they were not owners of the vehicle, and the case was based solely on secret information without proper investigation. The State opposed the petition for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties, and conditioned the order on verification of the petitioners' criminal antecedents. If more than one antecedent is found, the bail will not be confirmed; if only one antecedent is found, the bail will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Narcotic Substances Act.
Issues considered
- What is the appropriateness of granting anticipatory bail to the petitioners under the alleged offences?
- Whether the petitioners' alleged antecedent cases affect the grant of anticipatory bail?
