Patna High Court

Ranjan Yadav @ Niranjan YadavversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court held that bail could not be granted to the petitioner.

Summary

The petitioner, Ranjan Yadav, was arrested in connection with the murder of a school teacher, alleged to have been shot by a group that included the petitioner. He faces charges under Sections 103, 3(5) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The petitioner argued that he was never named in the FIR, that there is no material linking him to the crime, and that he has only been held on suspicion despite not being interrogated, though he has eight prior criminal cases. The State countered that the petitioner made a confessional statement admitting his role as one of the shooters, which is recorded in the case diary, and that three witnesses have been examined. After considering the submissions and the evidence, the court declined to grant bail, directing that the petitioner may reapply if the trial is not concluded within six months.

Issues considered

  • Whether bail should be granted to the petitioner under the charges of murder and illegal possession of arms.
  • Whether the absence of the petitioner’s name in the FIR and lack of material evidence suffices for bail.
  • Whether the petitioner’s confessional statement and the presence of witnesses preclude bail.
