BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

The petitioner, Dheeraj Kumar Thakur, was arrested in connection with a case registered under Sections 137(2) and 87 of the Bharatiya Nyaya Sanhita, alleged to have abducted a victim. The prosecution alleged abduction, but the victim’s statement indicated she had gone of her own volition and made no accusation against the petitioner. The petitioner had been in custody since 23 September 2025 and filed a bail application before the Patna High Court. The court examined the victim’s statement, the nature of the alleged offences, and the lack of incriminating evidence. Considering these facts, the court held that the petitioner was entitled to bail. The court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to satisfaction of the Chief Judicial Magistrate, Gaya.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 137(2) and 87 of the Bharatiya Nyaya Sanhita given the victim’s statement and lack of incriminating evidence?
