BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner, subject to cash bond, sureties and conditions of appearance.

Summary

Akal Sah was arrested in connection with a violent incident in which he was alleged to have participated in a sword attack on Dhirendra Sah, causing grievous injury, and to have assaulted two rescuers with lathis. He faces charges under Sections 126(2), 115(2), 117(2), 118(1), 303(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner contended that he is innocent, has no criminal record, no incriminating material was found on him, and that the dispute was a trivial neighbourhood matter; he also pointed out that co‑accused have already been granted bail. The State opposed the bail application. Considering the lack of prior record, the duration of custody already served, and the circumstances of the case, the Court decided to grant bail subject to a cash bond of Rs. 15,000 and two sureties, with conditions regarding family surety and regular appearance in court.

Issues considered

  • Whether bail should be granted to the petitioner accused of offences under the Bharatiya Nyaya Sanhita, 2023, given the nature of the alleged assault and the period of custody already served.
