Holding

The court granted regular bail to the petitioner.

Summary

Shivam Kumar was arrested in connection with a case alleging attempted rape of a minor girl, entry into her room armed with a weapon, and offences under sections 126(2), 115(2), 76, 352, 351(2), 3(5) of the B.N.S. and Section 8 of the POCSO Act. The victim’s statement under Sections 180 and 183 of the BNSS alleged that the petitioner entered her room and attempted rape, while the FIR described a different scenario, creating a discrepancy. The petitioner claimed innocence, stating that he and the victim were in a consensual relationship and that no crime occurred, and highlighted his clean criminal record and prolonged pre‑trial detention since 30‑05‑2025. The State opposed bail, citing the seriousness of the charges. After hearing both sides, the court found that the inconsistencies and the petitioner’s lack of prior record warranted the grant of regular bail, subject to a bond of Rs 10,000 and two sureties, to be satisfied by the Special Judge (POCSO).

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under the POCSO Act and other serious offences.
  • Whether the discrepancies between the FIR and the victim’s statement affect the bail decision.
  • Whether the petitioner’s clean criminal antecedent and prolonged pre‑trial custody justify bail.
