Patna High Court

Ramayan Sahni @ Ramayan ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the petitioner's clean antecedent and lack of direct evidence, bail was permissible under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Ramayan Sahni, sought bail in a case where he was implicated through confessional statements of co-accused for offences under IPC sections 302, 201 and 34. He argued that he was not named in the FIR and there was no direct material linking him to the murder of the informant's daughter. The State opposed the bail, contending the seriousness of the charges. The court noted the petitioner's clean antecedent, the absence of evidence beyond the confessional statements, and the fact that co-accused had already been granted bail. Accordingly, the court ordered bail on a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether bail can be granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita despite allegations under IPC sections 302, 201 and 34.
  • Whether the confessional statements of co-accused constitute sufficient basis to deny bail.
