Patna High Court

Pradeep Kumar @ Deepak MehtaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

The petitioner, Pradeep Kumar, sought bail in a case registered as Patarghat P.S. Case No. 93 of 2025, alleging offences under Section 309(6) of the B.N.S., 2023 and Section 27 of the Arms Act. The prosecution alleged that the petitioner, along with a co‑accused, was involved in a conspiracy to commit robbery and that a confessional statement of another accused, Babloo Kumar, implicated him. The petitioner argued that no material was recovered from him, he has no prior criminal record, and he has been in judicial custody since 9 August 2025. The State opposed bail, citing the seriousness of the offences. After hearing both sides, the court found the circumstances warranted bail and ordered the petitioner to be released on a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner under Section 309(6) of the B.N.S., 2023 and Section 27 of the Arms Act.
  • Whether the confessional statement of a co‑accused is sufficient to justify denial of bail.
  • Whether the petitioner’s lack of prior criminal antecedent and absence of recovered material favor bail.
