Patna High Court

Washim AnshariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to bail in the case.

Summary

The petitioner, Washim Anshari, was arrested in connection with the alleged recovery of 200 litres of spirit from two vehicles and a newly constructed house, offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. He contended that he was not the owner of the seized vehicles or the house and that his proximity to the site led to his implication, further alleging that the investigation was mechanical. The petitioner had an antecedent case and had been in custody since 4 July 2025, with a charge‑sheet already filed. The State opposed the bail application. The Court, after considering the petitioner's submissions, held that bail was appropriate and ordered his release on a bond of Rs. 10,000 with two sureties of the same amount.
