Decided

BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a bond and sureties.

Summary

The petitioner, Narendra Yadav, sought anticipatory bail fearing arrest in a case (Kharia P.S. Case No. 349/2025) alleging offences under Sections 126(2), 115(2), 109(1), 351(2), 352 and 3(5) of the B.N.S. 2023. The FIR alleged that Yadav and others entered the informant’s house, abused her and assaulted her with a sword, causing a head injury. Yadav’s counsel argued that the informant is a relative (the father‑in‑law’s sister) and the dispute stems from a land conflict, and that the injuries are simple. The court considered the familial relationship, the nature of the dispute, and the modest severity of the injuries. Finding no compelling reason to deny bail, the judge granted anticipatory bail subject to a bond of Rs. 10,000 and two sureties, with conditions under Section 482(2) of the B.N.S.S. The order is effective for four weeks from the date of the order.
