Dhiraj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners, finding the injuries simple and the dispute a prior matter.

Summary

The petitioners, Dhiraj Kumar and Mukesh Kumar, were implicated in a police case alleging assault with lathis and bricks, resulting in simple injuries to an informant and his cousin. They filed an application for anticipatory bail, contending that they were falsely implicated due to a prior drainage dispute and that both parties are agnates. The court noted the prior case filed by the petitioners, the simple nature of the injuries, and the familial relationship between the parties. Considering these factors, the court was inclined to grant anticipatory bail. The application was allowed, directing the petitioners to furnish bail bonds and sureties within four weeks, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the Bharatiya Nagarik Suraksha Sanhita, 2023
  • Whether the nature of injuries and the existence of a prior dispute justify bail
  • Whether the familial (agnate) relationship between parties influences the bail decision
