Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner.

Summary

The petitioner, Bhikhar Sao, was charged under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly recovering 720 litres of liquor from a car. He has three prior cases but was not arrested at the scene and no liquor was found in his possession; he was implicated solely on suspicion and has been in custody since 21-11-2025. The petitioner applied for bail, arguing lack of direct evidence and his continued detention. The State opposed the bail application. The Court, after considering the submissions, ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, pending trial in the Muffasil P.S. case No. 137 of 2020.
